โ“ Frequently Asked Questions

What counts as "normal wear and tear" in Colorado?
Normal wear and tear includes minor scuffs on walls, small nail holes (1-2 per wall), slight carpet wear in high-traffic areas, faded paint, and minor scratches on hardwood. You cannot deduct for these. Deductible damage includes: large holes in walls, stains from pets or spills, broken fixtures, missing hardware, excessive filth, unauthorized modifications, and damage beyond normal aging.
How should I document damage for deposit deductions?
Take date-stamped photos of every room, comparing to move-in condition photos if available. Write specific descriptions ("3-inch hole in bedroom wall behind door" not "wall damage"). Colorado courts favor landlords who provide detailed, itemized deductions with photographic evidence. Pro tip: use a ruler or coin for scale in damage photos.
What's the 30-day rule for security deposits?
Under C.R.S. ยง 38-12-103, you must return the deposit or mail a written itemized statement within 30 days of lease termination (or up to 60 days if your lease specifies). Miss the deadline and you may forfeit the right to withhold ANY of the deposit โ€” plus potentially owe treble damages (3x the deposit). Start your inspection ASAP after move-out.
Can I charge for carpet cleaning or repainting?
Only if the damage exceeds normal wear. For carpet: pet stains, burns, or large food stains are deductible; normal traffic wear is not. For paint: large holes, crayon marks, unauthorized colors, or smoke damage are deductible; small nail holes and slight fading are not. Colorado uses a "useful life" proration โ€” if 10-year carpet is 8 years old, you can only charge for 20% of replacement cost, regardless of damage.
Why generate a checklist instead of using a generic template?
Generic checklists miss property-specific items. A house with a garage needs exterior/garage checks. A pet-friendly unit needs odor and damage-specific items. A furnished rental needs furniture condition checks. This generator creates a checklist tailored to YOUR property's rooms, features, and lease terms โ€” so nothing gets missed during the walkthrough.
Can I use this checklist in court?
This checklist is a documentation aid, not legal advice. However, a completed checklist with photos for each item is exactly what Colorado courts want to see. Judges look for: (1) itemized list of damage, (2) photographic evidence, (3) comparison to move-in condition, (4) reasonable cost estimates. This checklist structures your inspection to provide all four.
